voici le message que ma soeur a reçu de son FAI (club internet)

Est ce a prendre au serieux ou est ce pour faire peur? :/

musicales via les systemes peer to peer accessibles sur le reseau
internet.

Nous vous rappelons que cette pratique est contraire a la legislation
francaise des lors que vous ne disposez pas des droits ou autorisations
pour realiser de tels actes.

Aussi, a defaut d'etre titulaire des droits ou autorisations sur le ou
les contenus concernes, nous vous conseillons vivement de cesser cette
pratique dans les plus brefs delais afin de vous premunir d'une
eventuelle plainte deposee a votre encontre par l'organisme possedant
les droits sur ce ou ces contenus.

Alors le service Abuse est un service qui existe bien dans chaque FAI.

Et ils n'ont pas le droit de divulguer le nom de celui qui leur à écrit. Mais en général ces services s'occupent des spam ou bomber mail.
Alors le p2p j'ai un peu des doutes sur l'authenticité du mail, peut etre une blague.

En tout cas si tu es sûr que cela vient bien du Abuse de ton FAI, alors méfie toi quand même. Mais bon le problème c'est qu'ils peuvent te prévenir mais sauf si enquète, le p2p n'étant pas illégal par soi-même, seul l'échange de fichiers portant une licence est interdit.
Il faudrait qu'il donne une preuve de ce que tu télécharges ou échange.

Moi à ta place, si tu es sûr que le message vient de Abuse@club-internet.fr , tu leur réponds en demandant pourquoi tu recevais un tel mail. Prêche le faux pour le vrai et demande pourquoi on t'incrimine d'échange de fichiers illicites et sur quelles preuves cette dénociation prouve ses déclarations.

Reste soft avec eux, pas de violence dans tes courriers mais surtout faut leur répondre. Je te le redis pour la 3em fois, soi bien sûr de la provenance du mail avant !!!.

En plus ils te donnent l'info car bon y a pas photo , c'est paramount derrière. Mais au moins tu le téléchargais vraiment ce film ?

Il s'agit bien d'un mail officiel de club internet, le Fai s'est exactement ce que tu télécharge, et il suffit qu'un major contact le Fai pour que ce dernier te prévienne, car le Fai va plutôt annulé ta connexion, que plutot etre au tribunal face au major, donc un conseil efface ce que tu as sur ton disque dur et ne télécharge plus rien d'illégal, en téléchargeant illégalement tu savais que tu étais dans l'illégalité, donc ce genre de message est logique. Tu as de la chance, si il n'y a pas de plainte derrière contre toi. :/

Salut à tous, je viens de recevoir le même message de club!

A mon avis, comme il y a des fake (on croit télécharger un film avec le bon titre et on obtient un gros porno), il doit y avoir des films, qui de part leurs contenus numérique, que l'on peut "tracer". Pas de coupe-feu, puisqu'on est en P2P!
En fait tu télécharges ce que tu veux, mais il n'aiment pas que tu le laisses dans ton dossier partagé puisque tu apportes une pierre à l'édifice du P2P.
Le mailing de la Paramount est automatisé, je vois mal le monsieur de Californie s'occuper de millions de gens!
En d'autre thermes, tu vires les films (surtout récents) de ton dossier partage, tu gardes les épisodes TV de Cold Case ou CSI, tu y ajoute un peu de porno et t'as tout bon!
De toute manière, j'ai Canal+ et suis innondé de films, je cherche juste a les stocker sur PC!
En conclusion, suis mes conseil et dort tranquille, le "SWAT" ne va pas débarquer chez nous avec des fusils à pompe!

P.S. :Il est naïf de croire que les fichiers que l'on téléchargent viennent de nos propres PC, ils sont bien entier, de plus ou moins bonne qualité selon leurs origines, et ce sur des serveurs, d'où la fermeture de Razorback, la garde à vue du dirigeant de eMule-Paradise etc... C'est la guerre du FRIC!

Quand tu recevra un courier par la poste avec accuse de reception de CI avec une notification de rappel au loi N°*** Art. *** etc.. alors la tu pourras le prendre au serieux. Un mail n'a aucune valeur juridique. Il faut un suivie comme quoi ils t'ont bien averti de ce que tu encouré.

J'ai recu un mail du meme genre mais encore mieux fait, avec les references aux articles de loi etc... et c'est un site qui permet d'envoyer ces mails pour des blagues d'amis ... Blague un peu douteuse à mon gout.

D'ailleurs je te rappel que le mail est reconnu juridiquement, il a la même valeur qu'un courrier (Cour de cassation jurisprudence 2001). ;)

prouver la provenance est une chose,prouver la reception en est une autre
pour l'instant la seule chose reconnu a 100 % c'est un courrier recommander avec AR
